The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No. 709/2015, registered for the offences punishable under Sections 384, 379 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that the petitioner and others surrounded the informant. The petitioner Dimpal Roy pointed rifle on the informant and demanded extortion. The accused persons assaulted the informant with butt of rifle, lathi and other weapons and snatched Rs. 25,000/- and mobile from possession of the informant.
Learned counsel for the petitioner submits that the petitioner is co-villager of the informant and the petitioner has
Patna High Court Cr.Misc. No.30 of 2017 (3) dt.02-03-2017 2/2 falsely been implicated in the case due to village politics. Similarly situated co-accused Pintu Roy @ Doman Roy and Krishna Rai have already been granted bail vide order passed in Cr. Misc. No. 33362/2016 and 17983/2016. The case of the petitioner stands on the same footing. The petitioner is in jail since 02.11.2016. He has already remained in jail for four months. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 709/2015.
