JUSTICE ARUN KUMAR ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Khizersarai P.S.Case No. 111/2016 registered for the offences punishable under sections 328 and 302/34 of the Indian Penal Code and sections 3/4 of the Dowry Prohibition Act.
The allegation is that petitioner's son was married with the informant's daughter ten years back and again he married with another lady and it is alleged that the accused persons administered poison to her due to which she died. The submission on behalf of the petitioner is that the petitioner is mother-in-law of the deceased and the husband and the father-in-law of the deceased are in custody. In fact due to second marriage of her husband she had made an attempt to commit suicide. Soon thereafter the family members brought her
Patna High Court Cr.Misc. No.5691 of 2017 (3) dt.22-02-2017 to hospital for treatment. During the course of treatment she died after two days. Her statement was not recorded during her hospitalization.
Having considered the said facts and circumstances, the petitioner Ganeshwari Devi, in the event of her arrest or surrender before the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.III, Gaya in Khizersarai P.S.Case No. 111/2016, subject to the conditions as laid down under section 438(2) Cr.P.C.
