The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 307, 341, 504/34 of the Indian Penal Code and 3(1) (xi) (xv)of the S.C./S.T.(Prevention of Atrocities) Act. Prosecution case is that the petitioner and her parents assaulted the informant and catching hold of her hair. In the meantime the son of the informant came to rescue, when he was assaulted with iron rod by coaccused Gurucharan Thakur, causing injury on the eye, thereafter Naresh Thakur, Gurucharan Thakur and Kallu threatened the informant to kill her.

Patna High Court Cr.Misc. No.38167 of 2015 (2) dt.24-09-2015 accused Naresh Thakur. Accusation is omnibus and general in nature. It is submitted that it has been alleged that the petitioner has assaulted the son of the informant but he was assaulted by co-accused Gurucharan Thakur.

Considering the fact that the accusation is omnibus and general and petitioner has not assaulted the son of the informant, who received injury on his eye and petitioner is unmarried girl, let the above named petitioner be released on bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri A.K. Roy, Judicial Magistrate, Ist Class, City Court Patna in connection with Sultanganj P.S. Case No. 137 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
