The petitioner seeks bail in Udwantnagar P.S. Case No. 167/2017, instituted for the offences under Section 302 of the Indian Penal Code read with Section 27 of Arms Act. It is alleged in the written report that when the informant received information from one Abinash Kumar Singh that his brother has been killed, he reached at the place of occurrence and found his brother lying dead.
Learned counsel for the petitioner has submitted that petitioner is not named in the F.I.R. His name has come during course of investigation as one of the conspirator on the basis of confessional statement of co-accused Santosh Samrat. It is further submitted that aforesaid Santosh Samrat has already been granted
Patna High Court Cr.Misc. No.64253 of 2018 (2) dt.26-10-2018 2/2 bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 35754/2018 dated 27.06.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 167/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
