JUSTICE PARTHA SARTHY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioners and learned A.P.P for the State, through video conferencing. The petitioners have filed the instant application for grant of regular bail in connection with Manjhi P.S. Case no. 45 of 2020 registered under sections 30, 30(a), 38(i) and (ii) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on the car of the accused persons being stopped of which three petitioners were among it's five occupants, on search 211 litres of IMFL was recovered. It is submitted by learned counsel for the petitioners that the allegation of recovery is false and concocted. In any case the

Patna High Court CR. MISC. No.19146 of 2020(2) dt.04-06-2020 2/2 three petitioners are not the owner of the vehicle which belongs to one Bidhan Rai. The petitioners have no criminal antecedent and are in custody since 20.2.2020.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts that they are not the owner of the vehicle and are in custody since 20.2.2020, this Court is inclined to enlarge the petitioner on bail. The petitioners are directed to be enlarged on bail in connection with Manjhi P.S. Case no. 45 of 2020 on each of them furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cumSpecial Judge Excise, Saran.
