13-07-2020 Heard learned counsel for the parties through video conferencing.

This relates to grant of bail in S.T. No. 230 of 2019, arising out of Sour Bazar P.S. Case No. 300 of 2019, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Sections 25(1-b)a/26/27/35 of the Arms Act.

As per prosecution case, one loaded desi katta and four live cartridges have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case and no such recovery has been made from the petitioner, but without any fault, the petitioner is in custody since 29-07-2019.

No.19042 of 2020(3) dt.13-07-2020 2/2 However, learned A.P.P. for the State has vehemently opposed the prayer for bail and submits that loaded desi katta alongwith live cartridges were recovered from possession of petitioner and petitioner has also criminal antecedent, as stated in paragraph - 3 of the petition.

Considering the aforesaid facts and circumstance as well as the fact that petitioner has got criminal antecedent of similar nature, I am not inclined to grant bail. The bail application is rejected.
