JUSTICE SANDEEP KUMAR ORAL ORDER 24-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Nagar P.S. Case No. 307 of 2015, registered for the offence punishable under Section 406 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on account of enmity. The present case has been filed after a delay of 10 years that too delay and without explaining the cause of delay. Petitioner is in custody since 21.10.2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed.
