2. The petitioner apprehends his arrest in connection with Ghoswari P.S. Case No.128/2022 dated 23.08.2022 for the offences punishable under Sections 302, 307, 326 and 120B/34 IPC, pending in the Court of learned Judicial Magistrate 1st Class, Barh, Patna.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.30676 of 2023(4) dt.06-12-2024 2/2 learned Court below within six weeks from today and seeks regular bail, the learned Court below would pass order on the same day in accordance with law considering the fact that no specific overt act has been attributed against the petitioner and there is previous enmity with the informant.
