28.08.2020 This is an application seeking quashing of the F.I.R. bearing Bettiah Muffasil P. S. Case No. 141 of 2014 dated 16.04.2014 instituted for the offences under Sections 409 and 34 of the Indian Penal Code. Before going into the merits of this case, Mr. Sanjeev Kumar, learned counsel for the petitioners candidly informed this Court that charge-sheet in this case has already been submitted but till date cognizance has not been taken.

In any view of the matter, since charge-sheet has been submitted in this case, I am not inclined to entertain this application for quashing of the F.I.R. The petitioners would be at liberty to agitate before the Court at the stage of cognizance and at later stages, if they so wish. They will have the liberty to avail of the remedies to which they are entitled.
