JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-09-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 25.07.2016 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.

Prosecution case is that informant Sunil Kumar Rajak being the S.I. cum In charge of Chero O.P. received information that the petitioner used to keep Ganja in his shop when raid was laid and a person with a bag was apprehended who disclosed his name as Abhay Kumar Singh, the petitioner. From the bag of the petitioner, 300 grams of ganja were recovered. It is submitted by the learned counsel for the petitioner that the recovery is of small quantity. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.41938 of 2016 (2) dt.23-09-2016 2/2 Mr. J.N. Thakur, learned APP does not controvert the quantum of recovery.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Nalanda at Biharsharif in connection with Harnaut (Chero) P.S. Case No. 203 of 2016.
