The learned counsel for the petitioner submits that the petitioner was granted provisional anticipatory bail by order dated 25.05.2022 in Cr. Misc. No.25272 of 2021. It is next submitted that when the matter was taken up for final disposal on 16.08.2022, the Court was pleased to grant anticipatory bail to the petitioner.

The learned counsel for the petitioner submits that since the bail bonds were already accepted when provisional bail was granted to the petitioner, as such, the subsequent order i.e. 16.08.2022 ought to have confirmed the provisional bail

Patna High Court CR. MISC. No.29326 of 2023(2) dt.10-05-2023 2/2 instead of granting anticipatory bail to the petitioner. The learned counsel thus submits that the order dated 16.08.2022 in Cr. Misc. No.25272 of 2021 be modified to read as that the provisional bail of the petitioner is confirmed on the same terms and conditions as recorded in the order dated 25.05.2022 in Cr. Misc. No.25272 of 2021.

Considering the submission made by the learned counsel for the petitioner, the order dated 16.08.2022 is modified to read as that the provisional bail of the petitioner is hereby confirmed on the same terms and conditions as recorded in the order dated 25.05.2022 in Cr. Misc. No.25272 of 2021. The modification application is allowed accordingly.
