JUSTICE PARTHA SARTHY ORAL ORDER 29-05-2020 Heard learned counsel for the petitioner and learned A.P.P for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Darauli P.S. Case no. 139 of 2019 registered under sections 272, 273, 420 and 120B of the Indian Penal Code and sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.
As per allegation in the F.I.R., the petitioners were arrested from Bolero vehicle and there was a recovery of 273.8 litres of IMFL.
It is submitted by learned counsel for the petitioner that the petitioner had moved this Court earlier for bail vide Cr.Misc.no.71479 of 2019 which was dismissed by order dated 13.1.2020 (Annexure-1) with the liberty to the petitioner to
Patna High Court CR. MISC. No. 18916 of 2020(3) dt.29-05-2020 2/2 renew the prayer for bail once charge has been framed. It is submitted that the petitioner has no criminal antecedent, is in custody since 28.8.2019 and charge has been framed in the instant case on 12.12.2019 which would be evident from the order of the learned Court below rejecting his application for bail.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Darauli P.S. Case no. 139 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Siwan.
