JUSTICE SUDHIR SINGH ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b) a, 26 and 35 of the Arms Act and 3 /4 of the Explosive Substances Act.

Allegation is that petitioner along with other accused persons was apprehended while they were preparing to commit crime and from their possession arms were recovered. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 5.7.2016. Chargesheet has been submitted against petitioner. One magazine of a pistol along with live cartridge is said to have been recovered from possession of petitioner. There is no compliance under Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
