It appears that vide order dated 16.04.2015, the applications with regard to petitioner Nos. 2 and 4 were directed to be disposed off since they have been arrested. Petitioner Nos. 1, 3 and 5 are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 326, 379, 504, 506, 509 of the Indian Penal Code.
It is alleged that petitioner No. 1 misbehaved with the wife of the informant and when it was protested by the informant's side then the accused persons assaulted the informant and his two brothers.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.46828 of 2014 (3) dt.24-04-2015 2/2 petitioners that injuries have been found to be simple. There is counter version of the occurrence also and for the occurrence of 26.03.2014 the First Information Report was registered on 24.04.2014.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the delayed lodging of the First Information Report, let the petitioner Nos. 1, 3 and 5, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Pupri at Sitamarhi in connection with Bathnaha P.S. Case No. 125 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
