JUSTICE SUDHIR SINGH ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 414 of the Indian Penal Code.

Allegation against petitioner is that during vehicle checking one stolen motorcycle was recovered from his possession by the police.

It has been submitted on behalf of petitioner that he is in custody since 26.8.2016. He has got no criminal antecedent. Chargesheet has been submitted against him. No allegation of tampering of witnesses is alleged against him. Petitioner has been made accused due to mistake of fact. Petitioner had no knowledge that the motorcycle in question was a stolen property. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.50232 of 2016 (2) dt.21-11-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case no. 601 of 2016.
