Petitioner seeks bail in Sasaram Rail P.S. Case No.72 of 2018 instituted for the offence under Section(s) 401, 414/34 Indian Penal Code, Section 30-A of the Bihar Prohibition & Excise Act, 2016, and Sections 25(1-b)a, 26, 35 of the Arms Act.

From the written report, it appears that two live cartridges, three pieces foreign liquor each of 180 ML, two pair Payal etc. have been recovered from possession of the petitioner. Counsel for the petitioner submits that petitioner is in custody since 18.07.217 having clean antecedents. In the facts and circumstances of the case, prayer of

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya, in connection with Sasaram Rail P.S. Case No.72 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
