SINHA ORAL ORDER 07-10-2015 It is submitted on behalf of the petitioner that present case has been wrongly numbered as Kotaria (Jaipur) P.S. Case No. 67 of 2015 whereas it should be 66 of 2015 and necessary correction be made accordingly. Let court below look into the aforesaid submission made on behalf of the petitioner and act accordingly.

2. Petitioner is apprehending his arrest in connection with a case for the offence under Sections 304(B), 324/34 of the Penal Code registered after unnatural death of his sister-inlaw. It is submitted on behalf of the petitioner that though he is named in the First Information

Patna High Court Cr.Misc. No.40291 of 2015 (2) dt.07-10-2015 Report but there is neither specific overt act alleged against him nor any demand of dowry is attributed to him. Husband of the deceased is already in custody. Mother-in-law of the deceased who is alive has not been made accused in the case.

Let petitioner, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Katoria (Jaipur) P.S. Case No. 67 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
