JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Vanshi P.S. Case No. 46 of 2015, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is that daughter of the informant left the house in the evening of 13.11.2015 but she did not return. In course of search, informant came to know that his daughter was seen sitting on the motorcycle of Kundan Kumar. Before six months, this petitioner always used to talk with the daughter of the informant through mobile.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.17045 of 2017 (2) dt.16-05-2017 suspicion. Moreover, the victim in her statement as recorded under Section 164 Cr.P.C., in which, she stated about her moving to the house of her aunty (Moushi) according to her own sweet will and after two days she returned back from her aunty (Moushi) house and petitioner had not taken her.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate Ist, Arwal, in connection with Vanshi P.S. Case No. 46 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
