2. The petitioner seeks bail in connection with Barhara PS Case No.223 of 2022 dated 20.03.2022, instituted for the offence punishable under Sections 147, 148, 149, 307, 302, 326 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in short, is that while the son of the informant was standing near Panchayat Committee Hall on 20.03.2022 at about 3.00 PM, four bike borne accused persons arrived there and had assaulted him and thereafter they had fled away. It is further alleged that about 5.00 PM on the same day, the accused persons again arrived at the place of occurrence armed with rifle and co-accused Arbind Singh had
Patna High Court CR. MISC. No.19925 of 2023(2) dt.22-05-2023 2/2 fired on the son of the informant, Bhawani Bin, who sustained gun shot injury and succumbed to the same.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Main allegation of firing is again Arbind Singh. It is further submitted that similarly situated co-accused Jitendra Singh @ Jitu Singh has been granted bail by order dated 23.12.2022 passed in Cr. Misc. No. 59095 of 2022 by a co-ordinate Bench of this Court. Lastly, it is submitted that the petitioner is in custody since 21.11.2022 having clean antecedents and charge-sheet has been submitted in the case.
5. Learned APP has opposed the prayer for bail.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in Barhara PS Case No.223 of 2022.
