JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 354 of the Indian Penal Code and Section 8 of POCSO Act.

Petitioner is in jail custody since 12.06.2016 on the accusation that he having entered into the house of the informant teased the informant's minor daughter.

Submission on behalf of the petitioner is that the victim was examined in course of investigation and she stated a different story disclosing this fact that having heard some sound she opened her door and having seen the petitioner she cried which attracted the informant and others and after that the present

Patna High Court Cr.Misc. No.36952 of 2016 (2) dt.01-09-2016 2/2 case was lodged.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Buxar in connection with POCSO Case No. 14 of 2016 arising out of Brahampur P.S. Case No. 102 of 2016.
