JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-03-2017 The petitioner is apprehending his arrest in connection with Akbarpur P.S. Case No. 221 of 2014, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307 and 304 Indian Penal Code.

It has been submitted on behalf of the petitioner that there is delay of seven days in filing present case and only general and omnibus allegation has been levelled against the petitioner. Heard learned A.P.P. also.

Having heard both sides, from perusal of impugned order, it appears that the case is of the year 2014 and earlier his anticipatory bail petition was rejected by learned Sessions Judge in the year 2014 and again after lapse of three years a bail petition was filed, which was also dismissed by learned Sessions Judge

Patna High Court Cr.Misc. No.12099 of 2017 (2) dt.23-03-2017 2/2 and, thereafter, petitioner now has moved this Court for grant of anticipatory bail.

Considering the facts and circumstances of the case as well as conduct of the petitioner, I am not inclined to grant him privilege of anticipatory bail, it is accordingly rejected. Let petitioner surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case, without being prejudiced by the order of this Court.
