JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 272, and 273 of the Indian Penal Code and 47 of the Bihar Excise (Amendment) Act.

Allegation is that from the bed of river 120 litres of Mahua wine has been recovered.

It has been submitted on behalf of petitioner that he is in custody since 31.7.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that 120 litres of Mahua wine is said to have been recovered from the bed of river. No recovery has been made from conscious possession of petitioner. No compliance is made under Section 100 of the Code of Criminal Procedure. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.51509 of 2016 (2) dt.06-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, VIII, Saran, in connection with Revilganj P.S. Case no. 146 of 2016.
