This application has been filed for modification in order dated 26.2.2019 passed in Cr. Appeal (SJ)No.137 of 2019 by which the appellant was given interim protection till submission of the charge-sheet and he was directed to surrender and move before the learned court below after submission of the charge-sheet and pray for regular bail.

Submission of the learned counsel for the petitioner is that the charge-sheet had already been submitted at the time of order dated 26.2.2019 passed in Cr. Appeal No.137 of 2019 as such he has prayed for modification in the above order dated 26.2.2019.

The case is under Section 376, 504 and 506 of the

Patna High Court CR. MISC. No.22175 of 2019(2) dt.11-04-2019 2/2 Indian Penal Code and Section 3(i)(w) of SC/ST (Prevention of Atrocities) Act.

In such view of the matter, I am not inclined to interfere with the order rather let the petitioner surrender before the learned Special Judge within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered on the basis of materials available on the record and if possible to be disposed of on the same day.
