The petitioner seeks bail in Bind P.S. Case No.85/2017 registered under Sections 302/120B of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that while his brother was returning from his office, Sudhir Kumar informed him that his brother was shot dead by some unknown person. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R.. The name of the petitioner has figured in this case on the confessional statement of coaccused Sujeet Yadav and Ranjeet Yadav. Sujeet Yadav has already been granted bail vide order dated 10.05.2018 passed in Cr. Misc. No.22054 of 2018 and Ranjeet Yadav has also been

Patna High Court Cr.Misc. No.61691 of 2018 (2) dt.08-10-2018 2/2 granted bail vide order dated 16.02.2018 passed in Cr. Misc. No.3744 of 2018 by different co-ordinate Benches of this Court. The case of the petitioner stands on the similar footing as no specific allegation is made against the petitioner. Considering the fact that the petitioner is not named in the F.I.R. and his name has surfaced in this case on the basis of confessional statement of co-accused, who have already been granted bail, the petitioner above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Nalanda at Biharsharif, in connection with Bind Case No.85/2017.
