JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-03-2015 This application has been filed for modification of the order dated 31.7.2013 passed in CWJC No. 13666 of 2012. By the said order dated 31.7.2013, the custody of the children, namely, Karan Jeet Singh and Kriti, the son and the daughter respectively of Respondent No.1 was granted in favour of the petitioner, their grandfather. Petitioner was directed to produce the children before the Court below i.e. Court of learned Principal Judge, Family Court, Bhojpur at Ara so that the Court might have the view before adjudicating upon the dispute in Guardianship Case No. 3 of 2011.

It has been submitted on behalf of the petitioner in support of the present modification application that the petitioner and children have security risk at Ara, if they are allowed to be produced without due police protection.

In view of the averments made in the modification

Patna High Court MJC No.4229 of 2014 (3) dt.25-03-2015 application and in view of the submission made on behalf of the petitioner, the order dated 31.7.2013 is modified to the following extent:- (1) The petitioner shall be required to produce the children before the Court below within one month from today.

(2) If the petitioner approaches the Superintendent of Police, Bhojpur at Ara, for any protection for the purpose of production of these children before the Court below along with an order of this Court, he will provide necessary protection to them for the said purpose.

This application is disposed of accordingly.
