The petitioner seeks bail in a case registered under Sections 363, 366A, 376, 307 of the Indian Penal Code and Sections 3/4/6 of the POCSO Act.

Allegation is that accused Suresh Urown entered into the house of the informant and kidnapped her daughter, namely, Buchni Kumari and on the next day Buchni Kumari was recovered from the house of Birendra Urown and sign of rape was found.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There

Patna High Court CR. MISC. No.21258 of 2019(2) dt.11-04-2019 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The victim girl has been recovered and her statement under Section 164 Cr.P.C. has been recorded. There is no allegation of sexual abuse alleged against the petitioner. It is further alleged that the petitioner may be released after completion of nine months in custody from 10.10.2018. On behalf of the State, it is submitted that the petitioner is not named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail, after completion of nine months in custody from 10.10.2018, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st-cum-Special Judge (POCSO), Purnea in connection with Special case No.32 of 2016 arising out of Sadar (Muffasil) P.S. case No.152 of 2016.
