The present application has been filed for modification of the order dated 09.12.2015 passed in Criminal Miscellaneous No.55724/2015 to the extent of extending the period of surrender in a case registered for the offences punishable under sections 114, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act.

Since for modification of the order dated 09.12.2015, the present modification application has been filed on 20.04.2017 more than two years of passing of the initial order, this Court is not inclined to interfere.

Accordingly the modification application is disposed of.

However, since the petitioner was granted anticipatory bail on merit, it is a case for consideration of prayer

Patna High Court Cr.Misc. No.19806 of 2017 (2) dt.26-04-2017 2/2 for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Muffasil P.S. Case No.176/2015, pending before the learned CJM, Gaya.
