Mr.Sri Ajay Kumar-1 ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-06-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sadar P.S. Case No. 35 of 2018, Sessions Trial No. 250/18 registered for the offence punishable under Section 399 and 403 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 35 of the Arms Act.

This is a second attempt on the part of the petitioner for grant of regular bail inasmuch as this Court by an earlier order dated 28.06.2018, had rejected the prayer of the petitioner for grant of regular bail especially on account of the fact that six other cases were pending against the petitioner. The learned counsel for the petitioner submits that though the charges levelled against the petitioner in the present case is not very grave but nonetheless since the petitioner

No.68766 of 2018(5) dt.20-06-2019 2/2 has already been granted bail in all the other six cases and charges have already been framed by the trial court in the present case by an order dated 20.05.2019 passed in Sessions Trial No. 250 of 2018, this Court can consider the case of the petitoiner for grant of regular bail sympathetically. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner, above named, on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-13th, Muzaffarpur in connection with Sadar P.S. Case No. 35 of 2018, S. Tr. No. 250 of 2018.

It is further directed that the petitioner shall appear on each and every date so fixed by the learned trial court in the on going trial and upon default in appearance on any one date, the present privilege of bail shall stand cancelled automatically and the petitioner would be taken into custody forthwith. The petition stands allowed.
