2. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 363/366 of the Indian Penal Code.

3. As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner and the victim were known to each others. There was love affair between them. Both of them got

Patna High Court CR. MISC. No.20674 of 2025(3) dt.10-07-2025 2/2 married and are living in Delhi as husband and wife. The victim in her statement recorded under Section 164 Cr. P.C. denied the factum of kidnapping. She stated that on the previous night she was thrashed by her mother and hence she left the house on her own accord, went to Delhi with the petitioner. The victim has stated her age as 18 years. Petitioner claims clean antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and the statement of the girl under Section 164 of the Cr. P.C., in the event of arrest or surrender before the Court below within eight weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna City, Patna in connection with Daniyawan P.S. Case No. 114/2019, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Singh, J) Saif/- U T
