JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 364 of 2018, disclosing offences under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Case is under Section 498-A of IPC with an allegation of demand of dowry and torture.

On appearance of both the parties, matter was referred to the Patna High Court Mediation and Reconciliation Center vide order dated 10.05.2019 and the report of Mediator is

Patna High Court CR. MISC. No.21665 of 2019(3) dt.08-07-2019 2/3 available at Flag "M" which shows that mediation failed. However, learned counsel for the petitioner has submitted that he is still ready to keep her with dignity and care, but she is not ready to live in the joint family house. On the other hand, learned counsel for the opposite party no.2 has appeared and submitted that she has no objection if she is allowed to live with dignity and care. In such view of the matter, as stated above, let the petitioner, above named, surrender before the learned court below on 18.07.2019 and on that day, the opposite party no.2 shall also remain present in the Court.

Further on filing of the affidavit by the petitioner that he is ready to keep her with full dignity and care and will take her from the Court itself, the learned court below shall release the petitioner on provisional bail for a period of six months. During that period, the learned court below shall watch the conduct and marital relationship of both the parties, especially the conduct of the petitioner and further directs that both the parties shall appear in the second week of each month before the learned court below.

Patna High Court CR. MISC. No.21665 of 2019(3) dt.08-07-2019 3/3 cancelling the bail bonds of the petitioner.

With the aforesaid observations, this application is disposed of.
