JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsels for the petitioner, informant and learned counsel for the State The petitioner is apprehending his arrest in connection with Brahmpur P.S. Case No. 149 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 307, 379 of the IPC and 27 of the Arms Act.
It is alleged that the petitioner fired from the gun upon the informant with intent to kill which hit on his right leg and fell down and thereafter took cash Rs. 20,000/- and golden chain weighing two Bhar and thereafter trade towards east with his companion.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted
Patna High Court Cr.Misc. No.39473 of 2015 (2) dt.28-09-2015 2/2 that the petitioner has falsely been implicated in the present case. It is further submitted that 144 Cr. P.C. proceeding is also pending between the parties. There is an admitted land dispute between the parties. From perusal of the injury report which is Annexure-4, it would appear that the injury is simple in nature. On behalf of the learned counsels for the informant and the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Brahmpur P.S. Case No. 149/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
