JUSTICE SANJAY PRIYA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 399 and 402 of the Indian Penal Code.

It is alleged that during course of patrolling the informant received information to the effect that one fugitive Bhuali Hazra wanted in several cases was staying in the house of one Ramesh. The informant on such information reached at the house and heard 4-5 persons were talking with each other and taking the name of the petitioner. The informant alleged that all the accused persons were making preparation for dacoity. It is mentioned in paragraph-3 that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Bettiah Muffasil P.S. Case No. 91 of 2012, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
