JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT Date: 11-10-2017 Learned counsel for the petitioner submits that the petitioner is neither driver nor the owner of the vehicle which has been seized by the police and against which the present prosecution has been launched. This being the position, learned counsel, after some argument, seeks permission to withdraw this application to raise this plea in the court below at the time of framing of charge. Permission is granted.
The court below shall consider all such pleas which are available to the petitioner at the time of framing of charge. The impugned order is not interfered with.
