JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,380,427,436 and 504/34 of the Indian Penal Code. The prosecution case is that the informant when returned after attending the marriage, found petitioner no. 1 in her house when protest was made then the informant was assaulted by the accused persons including the petitioners. When the informant's daughter came to rescue then she was also assaulted and jewellery was snatched. It is further alleged that after taking out money the box containing clothes was set on fire.

No.37728 of 2015 (2) dt.18-09-2015 2/2 It is submitted by the learned counsel for the petitioners that for the petty dispute between the children of both sides the accusation has been levelled and even assuming the accusation the offence under section 436 IPC is not made out. More over, the accusation is omnibus and general in nature. There is counter version of the occurrence also. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Gopalganj in connection with Uchkagaon P.S. Case No.59 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
