JUSTICE PARTHA SARTHY ORAL ORDER 12-10-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. It is directed that the orders dated 21.09.2020 and 28.09.2020 shall be read as order nos. 5 and 6 respectively. The petitioner has filed the instant application for grant of regular bail in connection with Excise Case No. 45 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the FIR, on a raid being conducted 34.480 litres of illegal wine was recovered from the motorcycle of the petitioner and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.19157 of 2020(7) dt.12-10-2020 2/2 that no recovery as alleged has taken place from the possession of the petitioner or his motorcycle. He has been falsely implicated in this case and is in custody since 11.2.2020. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner being in custody since 11.2.2020, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Excise Case No. 45 of 2020 on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise, Gopalganj.
