JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No. 07/2017 registered for the offences punishable under Sections 341, 323, 354/34 of the Indian Penal Code and Section 3 / 4 of the Witch (Daain) Act. All Sections are bailable in nature, except Section 3 / 4 of the Witch (Daain) Act.
However, it is informed that the informant is distant agnate of the petitioner and other accused and the present case has been brought by the informant on account of land dispute. It is submitted that a partition suit is also pending between the parties.
Although, the petitioner is said to have made attempt

No.69470 of 2018(2) dt.17-12-2018 2/2 to outrage the modesty of the informant but considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in Laheriasarai P.S. Case No. 07/2017 subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Spd/- U T
