2. The petitioner seeks bail in a case registered for offence under Sections 366(A)/34 and 120(B) of the Indian Penal Code.

3. The prosecution case, in brief, is that on 20.09.2023 at about 11:30 PM, while informant was sleeping in her house, six F.I.R. named accused persons including this petitioner came and kidnapped her 14 years old minor daughter.

4. It is submitted on behalf of petitioner that there was love affairs in between co-accused Pinkesh Kumar and informant's daughter and petitioner has been implicated in this case merely because he happens to be own brother of coaccused Pinkesh Kumar. Moreover, the girl has already been recovered. Petitioner has got clean antecedent and is in custody since 18.01.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari (Poura) P.S. Case No. 347 of 2023.
