JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420,467, 468, 491 and 504 of the Indian Penal Code.

Allegation against the petitioner is that he is an agent of the company and defalcated public money which was collected on the pretext of giving good commission.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that no specific amount has been mentioned by any of the witnesses as to how much money they have collected and petitioner has already resigned from the company in the year 2013. Petitioner has falsely been implicated in the present case.

Considering all aspects of the matter, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.

However, petitioner is directed to surrender in the court below at Gopalganj in connection with Hathua P. S. Case no. 128 of 2015 and make prayer for regular bail which will be considered and disposed of preferably on the same day on its own merit without being prejudiced by the order of this Court. This application is accordingly dismissed.
