====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Saraiya P. S. Case No.606 of 2020, instituted for the offences under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 13.11.2020 and charge-sheet has been submitted in the case.

Allegation is of recovery of 8082.36 litres of foreign liquor from a container vehicle bearing registration no.HR-55S2288. Apart from the foreign liquor, some documents and mobile phone were also recovered from the vehicle. Coaccused, who was apprehended, disclosed the name of Pankaj

Patna High Court CR. MISC. No.31126 of 2021(2) dt.25-11-2021 2/2 Rai, Sanjay Singh, Sandeep Singh (petitioner) and Rajiv Kumar Singh that they are indulged in business of illegal liquor trade. Learned counsel for the petitioner submits that the name of this petitioner was disclosed by the apprehended coaccused and the petitioner was not present when the alleged seizure was made.

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 13.11.2020 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Saraiya P. S. Case No.606 of 2020.

The application stands allowed.
