Petitioner, who is in custody, seeks bail in connection with Itarhi P.S. Case No. 233 of 2018 registered for the offences punishable under Sections 414 of the Indian Penal Code and Section 25 (1-b)a.26,35 of the Arms Act. Allegation against the petitioner is of recovery of one cartridge and one without number Platina Baja Motorcycle also.

It has been submitted that petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the possession of the petitioner and the alleged recovery from co-accused Rahul Singh. Petitioner is in custody since 25.08.2018.

No.64994 of 2018(2) dt.05-11-2018 2/2 Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar, in connection with Itarhi P.S. Case No. 233 of 2018.
