In this case, the petitioner is seeking bail in connection with Dhanarua P.S. Case No. 52 of 2020 registered for offences under sections 302, 120(B) of the Indian Penal Code.
It has been alleged that the dispute arose for trivial matter whereupon Ranjeet Prasad came with Lathi and started to assault the husband of the Informant by Lathi on his head due to which he fell down on the ground and died at the spot. Allegation has been made by the Informant that her brother-in-law, namely, Ramashraya Prasad, her cousin brother-in-laws, namely, Bishun Prasad and Suranjan Kumar have actively participated in the killing of her husband and it
Patna High Court CR. MISC. No.20309 of 2020(2) dt.29-06-2020 2/2 has been alleged that the present petitioner was involved only in abatement for the commission of crime.
There is no such specific allegation has been made against the present petitioner and the only allegation has been made that she was committing an act of abatement. The petitioner, who is a lady, is languishing in jail custody since 13.2.2020.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi at Patna in connection with Dhanarua P.S. Case No. 52 of 2020, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner and (ii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
