2. The instant application for regular bail has been filed by the petitioner in connection with S.Tr. No. 510 of 2023 arising out of Baheri P.S. Case No. 270 of 2022 instituted for the offence u/s 302 of the Indian Penal Code.
3. Earlier the application for regular bail of the petitioner was rejected vide order dated 04.09.2023 passed in Cr. Misc. No. 7353 of 2023 with direction to the learned trial Court to expedite the trial and conclude the same soon.
4. It is submitted on behalf of the petitioner that there is no likelihood to conclude the trial in near future. The report of the trial Court shows that it will take none months to conclude the trial. The petitioner is in custody since 06.09.2022.

5. Learned APP appearing for the State has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstance of the case as well as considering the period of custody and there is no likelihood to conclude the trial in near future, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with S.Tr. No. 510 of 2023 arising out of Baheri P.S. Case No. 270 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Darbhanga.
