JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is named in the first information report but according to prosecution case itself, altogether 10 FIR named accused including the petitioner, made indiscriminate firing causing death of informant's brother and submission on behalf of petitioner is that having more or less similar allegation, one coaccused namely, Avnesh Singh @ Amresh Singh and Biran Singh @ Biru Singh, who are said to have been caught on the spot, just after the alleged occurrence, have already been granted privilege

Patna High Court Cr.Misc. No.37427 of 2016 (2) dt.08-09-2016 2/2 of bail by different benches of this court.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chousa P.S. Case No. 144 of 2014 to the satisfaction of learned Judicial Magistrate-Ist Class, Udakishunganj, Madhepura.
