JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in connection with Nauhatta P.S. Case No. 188 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325,308, 379, 504, 506 and 341 of the Indian Penal Code. It has been submitted on behalf of the petitioners that there is no specific overt act alleged against petitioner Nos. 2 and 3, rather there is general and omnibus allegation and against petitioner No.1 there is allegation of assault by spade on the leg but opinion of the injury was kept reserved and the injuries are on non-vital part of the body and petitioners have been implicated in

Patna High Court Cr.Misc. No.10155 of 2017 (2) dt.18-03-2017 2/2 this case due to village rivalry.

Having heard both sides and in view of the submissions made, let petitioners surrender and make prayer for regular bail, which shall be considered by the court taking into consideration the submission made as well as materials available in the case diary and the court below will pass appropriate order, without being prejudiced by this Court.
