JUSTICE PARTHA SARTHY ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and learned A.P.P for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Barauli P.S. Case no. 39 of 2020 registered under sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on a raid being conducted, a total of 21.2 litres of IMFL was recovered from the house of the petitioner and the petitioner who made an attempt to escape was caught.

It is submitted by learned counsel for the petitioner that no illicit liquor has been recovered and he has been falsely implicated in the case. The petitioner has no criminal antecedent and is in custody since 17.2.2020.

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has no criminal antecedent, he is in custody since 17.2.2020 and charge sheet has been submitted, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Barauli P.S. Case no. 39 of 2020 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Gopalganj.
