The petitioner is in custody in connection with Bachhwara P.S. Case No. 14 of 2020 for the offence under Sections 414 and 120 of the Indian Penal Code and Sections 30(a)32(2)/41(2) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 27.02.2020. He further submits that in the instant case total 1730.88 litres of country made liquor was seized from the field of Ram Badan Ram and Dona Ram and not from the field of petitioner.
Considering the fact that the petitioner is aged about 22 years having no criminal antecedents and the seizure was
Patna High Court CR. MISC. No.19023 of 2020(2) dt.13-05-2020 2/2 made from the field of Ram Badan Ram and Dona Ram and he is in custody since 27.02.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise , Bugusarai in connection with Bachhwara P.S. Case No. 14 of 2020 due to the circumstance of total lockdown on account of the pandemic of COVID-2019.
