Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends her arrest for the offences alleged under Sections 363/366(A)/376/120(B) of the Indian Penal Code, registered in connection with Falka P. S. Case No. 65 of 2020.

The learned counsel for the petitioner has submitted that the main allegation of kidnapping is against co-accused / Md. Danish and the petitioner has falsely been implicated in this case, as she is mother of aforesaid Md. Danish.

Patna High Court CR. MISC. No.30189 of 2021(2) dt.21-03-2022 2/2 The statement of the victim has been recorded under Section 164 of the Code of Criminal Procedure, in which she has not taken the name of the present petitioner; rather she has stated that Md. Danish had kidnapped her.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, in the event of her arrest or surrender within a period of four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI-cum-Special Judge, Katihar, in connection with Falka P. S. Case No. 65 of 2020., subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
