====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Sasaram (T) P.S. Case No. 412 of 2018, instituted for the offence under Section(s) 395 and 397 of the Indian Penal Code. Subsequently, Section 412 Indian Penal Code was added.

Counsel for the petitioner submits that First Information Report is against unknown. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Shivendra Dubey who has already been granted bail by coordinate Bench of this Court vide order dated 5.9.2018 passed in Cr. Misc. 38386 of 2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (T) P.S.
