JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Chapra Town P.S. Case No. 193/2014 for the offences instituted under Sections 409, 420, 467, 468,471 and 120(B) of the IPC. It is alleged that co-accused Indradeo Prasad being agent of Head Post Office, Chapra, persuaded the informant to invest in monthly income scheme to get handsome interest per month. The informant invested twelve lacs rupees through co-accused Indradeo Prasad but subsequently informant came to know that the alleged invested amount has been withdrawn by Indradeo Prasad in league with the petitioner being the Assistant Postmaster. No.39490 of 2015 (2) dt.28-09-2015 2/2 allegation against the petitioner is wholly misconceived on account of the fact that there is no statement that actually the withdrawals were made at the behest of this petitioner. The petitioner has been made accused due to mistake of fact. Other coaccused have been granted anticipatory bail by this Court vide Cr. Misc. Nos. 10689/2015 and 13802/2015.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R. and his name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Chapra Town P.S. Case No. 193/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
