The petitioner seeks regular bail in connection with Gardanibag Police Station Case No. 700 of 2019, registered for the offence punishable under Sections 452/380 of the Indian Penal Code.

The petitioner is not named in the First Information Report. It has been alleged in the First Information Report that the informant, on 18.11.2019, had gone outside her house for treatment and when she returned in the evening, she found the lock of her house broken and the jewellery and cash of Rs. 70,000/- were stolen from inside her house.

Patna High Court CR. MISC. No.18695 of 2020(3) dt.08-09-2020 2/3 Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged. He further submits that the name of the petitioner has transpired in this case on the basis of the confessional statement made by one Aman Raj @ Tengri, in another case, being Gardanibag Police Station Case No. 705 of 2019, where he has stated that the jewellery and other properties were stolen by his gang, including the petitioner, and he has also stated that the stolen jewellery is with the present petitioner, i.e. Prince Raj, for distribution. However, no stolen articles have been recovered from the possession of the petitioner in course of investigation. He further submits that the petitioner is in custody since 23.01.2020.

After having heard learned Counsel for the parties and taking into consideration the fact that the petitioner is in custody since 23.01.2020 and no stolen property has been recovered from his possession, I am inclined to grant regular bail to the petitioner.

This application is allowed.

Accordingly, let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each

It is made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding lockdown and social distancing.
